General Terms and Conditions (AGBs)

Scope

These General Terms and Conditions (AGBs) govern the use of the fabel app (hereinafter referred to as "App") by the users. The App is operated by Pflegeleicht - Carefix Digital Solutions UG (limited liability) (hereinafter referred to as "Operator" or "we"). By installing and using the App, the user accepts these AGBs. If the user does not agree to these conditions, the use of the App is not permitted.

Services of the App

The fabel App offers the user the opportunity to share tasks and appointments with an invited team. The App is free of charge.

Registration and User Account

Registration is required to use the App. The user is obliged to provide truthful and complete information during registration. The user is responsible for treating the access data to his user account confidentially and protecting it from access by third parties. In case of suspicion of misuse of the user account, the user is obliged to inform the Operator immediately.

Data Privacy

The collection and processing of personal data will be carried out in accordance with the applicable data protection regulations and the provisions of the App's privacy policy.

Copyrights and Usage Rights

All content of the App, such as texts, images, graphics, videos, software, and other materials are protected by copyright and other intellectual property rights. The user is granted only the non-exclusive and non-transferable usage rights to the content necessary for the private and personal use of the App. Any use, reproduction, distribution, or modification of the content beyond this is prohibited without the express consent of the rights holder.

Disclaimer of Liability

The App is provided to the best of our knowledge and belief. However, the Operator does not guarantee the accuracy, completeness, or timeliness of the provided information and content. The Operator is not liable for damages resulting from the use or non-use of the App or from third-party content linked to. The use of the App is at the user's own risk. The Operator is not liable for damages or disruptions caused by technical problems, viruses, or other harmful elements.

Changes to the AGBs

The Operator reserves the right to change or supplement these AGBs at any time. Changes to the AGBs will be communicated to the user in a timely manner and shall be deemed accepted if the user continues to use the App after the notification.

Termination of Use

The user can terminate the use of the App at any time by uninstalling the App. The Operator reserves the right to block or delete the App and the user account of the user without prior notice in case of a violation of these AGBs or misuse of the App.

Final Provisions

The laws of the Federal Republic of Germany shall apply. Should individual provisions of these AGBs be or become invalid, this shall not affect the validity of the remaining provisions. The place of jurisdiction for all disputes in connection with these AGBs and the use of the App is the registered office of the Operator.

Pflegeleicht - Carefix Digital Solutions UG (limited liability) is committed to actively relieve caring relatives in their everyday life. Our product fabel offers the possibility to share everyday life with a team and coordinate tasks and appointments. The processing of personal data is carried out exclusively for the purpose of the App and in strict compliance with the applicable data protection regulations.

Data Processing App Download

The App is downloaded through the Apple App Store. The following required information is transmitted to the App Store:

• Email address
• Device information and number
• If applicable, payment information
• Timestamp of the download

The processing and collection of this data is outside of our scope of responsibility. We only process information necessary for us to install the App on your smartphone.

Data Processing App Start
When opening the App, your smartphone connects to our server and third-party providers we use. The following information is processed:

• Device number
• Operating system version
• IP address
• Date and time
• Language settings

We process this data to provide you with the best possible application of the fabel App and to continuously improve our offering. This information is deleted after seven days (Art. 6 para. 1 sentence 1 lit. f GDPR).

We use third-party providers to collect the data but have carefully selected and instructed them on how to handle the data.

Data Processing User Registration

The fabel App requires a user account. The following information is required for registration:

• Email address
• Password
• Phone number
• Name
• Address

For verification of your registration, we will send a confirmation email with a code to your email address. This email correspondence will be processed by IONOS SE, according to our instructions.

The required data will be processed in accordance with our usage agreement in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR to create a user account. If you decide to delete your user account, we will adhere to the deletion regulations according to Art. 6 para. 1 lit. c GDPR.

Data Processing Functions

The fabel App supports you in your everyday life through coordination and collaboration functions. When using these functions, we process personal and health-related data in accordance with Art. 6 para. 1 sentence 1 lit. a, Art. 9 para. 2 lit. a GDPR, including:

• Nursing, everyday, or medical tasks and appointments, as well as corresponding notes (time, date, address, participants)
• Name of the person in need of care
• Communication between users regarding tasks and appointments

In our backend, the above-mentioned information is encrypted.

Analysis of Usage

We continuously work on improving and maintaining the fabel App. For this purpose, we process data according to Art. 6 para. 1 sentence 1 lit. f GDPR, which is separate and anonymized and cannot be traced back to your user account. For this purpose, we use Google Analytics based in Ireland.

Crash Analysis with Google Firebase Crashlytics

For continuous optimization of the fabel App, we regularly create reports on stability and functionality. For this purpose, we use Google Firebase Crashlytics and process the following personal data according to Art. 6 para. 1 sentence 1 lit. f GDPR:

• Operating system
• IP address
• Time and date of the problem
• Time and date of the app activation

The data collected is not associated with your user account and remains anonymous.

Transfer to Third Countries

Processing of personal data in third countries according to Art. 6 para. 1 sentence 1 lit. b GDPR (outside the EU & EEA) only takes place when:

• It is part of one of our contracts
• Legal obligations exist
• A legitimate interest is present

Service providers and third parties processing your personal data in a third country may do so only if permission has been granted in accordance with Art. 44 ff. GDPR.
